Megaupload knew exactly what was going on and even directed people to sites that indexed the copyrighted content. Mega upload was not a long term file storage service. If you know your server(s) are being used to store and transmit copyrighted material, and do nothing about it and promote the behavior, you are breaking the law in a majority of the countries of the world.
